Terms of Service

1 Acceptance

By accessing or using BestSchoolPage, the school agrees to these Terms of Service. If the school does not agree to these Terms, it must not use the platform.

2 Eligibility

BestSchoolPage is intended for educational institutions. Schools are responsible for ensuring that only authorized staff access administrator accounts.

3 Account Responsibility

Schools are responsible for:

• Maintaining password security
• Managing staff access
• Keeping account information accurate
• Protecting login credentials

Activities performed under a school's account are considered authorized unless reported otherwise. Schools must notify us immediately of any unauthorized access or suspected security breach.

4 Subscription & Payments

• Subscription fees are payable according to the selected plan.
• Failure to renew may result in suspension of premium features.
• Existing student data will not be immediately deleted following expiry.
• Outstanding payments do not transfer ownership of the software.

5 Acceptable Use

Schools must not:

• Upload unlawful or malicious content
• Attempt unauthorized access
• Reverse engineer the software
• Distribute malware
• Use the platform for fraudulent activities

6 Intellectual Property

BestSchoolPage owns the software, design, trademarks and source code. Schools own the educational data they upload. Schools grant BestSchoolPage a limited, non-exclusive license to process such data solely for the purpose of providing the services described in these Terms.

7 Service Availability

We aim for high system availability but cannot guarantee uninterrupted service. Maintenance, upgrades or unforeseen technical issues may temporarily affect access.

We reserve the right to modify, suspend, or discontinue any feature of the platform with reasonable notice where practicable.

8 Force Majeure

BestSchoolPage shall not be liable for any failure or delay in providing the Services where such failure or delay results from events beyond its reasonable control, including but not limited to internet outages, power failures, natural disasters, fire, flood, cyberattacks, telecommunications failures, government actions, strikes, or other unforeseen events.

Where reasonably practicable, BestSchoolPage will make reasonable efforts to restore the Services and notify affected schools of significant service disruptions.

9 Backups

BestSchoolPage performs periodic backups to improve data resilience. Schools are encouraged to export important reports where necessary.

10 Limitation of Liability

To the maximum extent permitted by applicable Nigerian law:

• BestSchoolPage shall not be liable for indirect or consequential losses, including business interruption, loss of profits, or loss of data.
• Our total aggregate liability arising from or related to these Terms shall not exceed the subscription fees paid by the school for the affected service period.
• Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, wilful misconduct, or death or personal injury caused by negligence.

11 Data Protection

Each party shall comply with its respective obligations under the Nigeria Data Protection Act 2023 (NDPA) and the General Application and Implementation Directive 2025 (GAID). As between the parties:

• The school is the data controller of student and institutional data uploaded to the platform.
• BestSchoolPage is the data processor and processes such data solely on the school's documented instructions.
• The school is responsible for obtaining all necessary consents from parents or guardians for the processing of student data, including consent for any processing beyond the educational purpose exception.
• BestSchoolPage will implement appropriate technical and organizational measures to protect personal data against unauthorized access, loss, alteration, or disclosure.
• In the event of a personal data breach, BestSchoolPage will notify the school without undue delay and, where required, assist the school in notifying the Nigeria Data Protection Commission (NDPC) within 72 hours.

12 Termination

We may suspend or terminate accounts that violate these Terms. Schools may also request account closure by contacting our support team.

Upon termination:

• The school's right to access the platform ceases immediately.
• BestSchoolPage will retain school data for a period necessary for backup, legal compliance, or dispute resolution, after which it will be securely deleted in accordance with our Privacy Policy.
• The school may request an export of its data before termination.

13 Dispute Resolution

Before commencing legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation.

If a dispute cannot be resolved within 30 days, it shall be submitted to mediation in Nigeria. Where mediation fails, the dispute shall be subject to the jurisdiction of the competent courts of the Federal Republic of Nigeria.

14 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.

15 Changes to These Terms

We may update these Terms periodically. Material changes will be communicated via the platform or email with reasonable advance notice. Continued use of the platform after such notification constitutes acceptance of the revised Terms.
